Al usar el sitio, escribirnos por cualquiera de nuestros canales o agendar una llamada, aceptas estas condiciones. Si no estás de acuerdo con alguna, lo mejor es decírnoslo antes de contratar: casi todo se puede conversar al principio y casi nada después.

Qué servicio prestamosWhat service we provide

Chimanta Work pone a disposición de empresas y profesionales espacios de trabajo equipados y los servicios que los acompañan: puestos de trabajo, oficinas privadas, salas de reunión por hora, oficina virtual con domicilio comercial y recepción, y los servicios comunes del edificio.

Chimanta Work makes equipped workspaces and their accompanying services available to companies and professionals: workstations, private offices, meeting rooms by the hour, a virtual office with a business address and reception, and the building's shared services.

Es un servicio de uso de espacio y de servicios asociados. No es un arrendamiento inmobiliario ni te otorga derecho de posesión sobre un inmueble, y no constituye domicilio fiscal salvo que así se acuerde expresamente por escrito en el servicio que corresponda.

It is a service for the use of space and associated services. It is not a property lease, it grants no right of possession over real estate, and it does not constitute a tax domicile unless expressly agreed in writing under the relevant service.

Lo que incluye cada modalidad está descrito en las páginas de espacios y de membresías. Si una descripción del sitio y el acuerdo firmado dicen cosas distintas, manda el acuerdo firmado.

What each option includes is described on the spaces and memberships pages. If a description on the site and the signed agreement say different things, the signed agreement prevails.

Quién puede contratarWho can contract

• Personas mayores de dieciocho años con capacidad legal para obligarse.People over eighteen with the legal capacity to enter into obligations.
• Empresas y organizaciones, a través de quien tenga facultad para representarlas. Al contratar en nombre de una empresa, declaras que puedes hacerlo.Companies and organisations, through someone empowered to represent them. When contracting on behalf of a company, you declare that you are able to do so.

Podemos pedir la identificación de quien firma y de las personas que van a usar el espacio. Es la misma comprobación que hace cualquier edificio con control de acceso, y sirve para lo mismo: saber quién está dentro.

We may ask for identification from whoever signs and from the people who will use the space. It is the same check any building with access control performs, and it serves the same purpose: knowing who is inside.

Podemos no aceptar o dar por terminada una contratación cuando el uso previsto sea contrario a la ley, ponga en riesgo a las demás personas del edificio o incumpla estas condiciones. Si eso ocurre, lo decimos por escrito y con el motivo.

We may decline or terminate a contract where the intended use is unlawful, puts other people in the building at risk, or breaches these terms. If that happens, we say so in writing and give the reason.

Reservas y confirmaciónBookings and confirmation

Una solicitud —por el formulario, por WhatsApp, por correo o en recepción— es una solicitud, no una reserva. La reserva existe cuando la confirmamos nosotros por escrito, indicando el espacio, la fecha, el horario y la tarifa.

A request — through the form, on WhatsApp, by email or at reception — is a request, not a booking. The booking exists once we confirm it in writing, stating the space, the date, the time and the rate.

El espacio queda reservado para el horario confirmado. Si necesitas más tiempo del reservado, lo extendemos si está libre, y se factura el tiempo adicional.

The space is held for the confirmed time slot. If you need more time than booked, we extend it when the space is free, and the additional time is invoiced.

Cambios y cancelacionesChanges and cancellations

Los plazos y las condiciones para cambiar o cancelar están en la confirmación de tu reserva o en el acuerdo que firmaste, porque no son iguales para una sala de dos horas y para una oficina de un año. Ahí es donde hay que mirarlos.

The deadlines and conditions for changing or cancelling are in your booking confirmation or in the agreement you signed, because they are not the same for a two-hour room and a one-year office. That is where to look for them.

Como criterio general: avisar temprano casi siempre se resuelve sin coste, y avisar cuando el espacio ya está preparado, no. Si te surge un imprevisto, escríbenos: preferimos mover una reserva que perderla.

As a general principle: telling us early can almost always be resolved at no cost, and telling us once the space is already set up cannot. If something unexpected comes up, write to us: we would rather move a booking than lose it.

Por nuestra parte, si una causa de fuerza mayor —falta de suministro eléctrico prolongada, un cierre del complejo, una emergencia— impide prestar el servicio contratado, te ofrecemos otro espacio equivalente, otra fecha o la devolución de lo pagado por la parte no prestada.

On our side, if force majeure — a prolonged power outage, a closure of the complex, an emergency — prevents us from providing the contracted service, we offer you an equivalent space, another date, or a refund of what was paid for the part not provided.

Tarifas y pagosRates and payments

En el sitio no publicamos tarifas. La razón es sencilla: el precio depende de cuántas personas son, de qué espacio ocupan y de por cuánto tiempo, y una cifra suelta en una página no le sirve a nadie para decidir. Te pasamos la tarifa que te corresponde por escrito, antes de que contrates.

We do not publish rates on the site. The reason is simple: the price depends on how many people you are, which space you occupy and for how long, and a figure on its own helps nobody decide. We send you the rate that applies to your case in writing, before you contract.

• La tarifa aplicable es la que aparece en la propuesta o en la confirmación de tu reserva, y es la que vale mientras dure el período acordado.The applicable rate is the one stated in the proposal or in your booking confirmation, and it holds for the agreed period.
• Los medios de pago aceptados, la moneda y el momento del pago se indican en esa misma propuesta o confirmación.Accepted payment methods, currency and payment timing are stated in that same proposal or confirmation.
• Los impuestos que correspondan según la normativa venezolana se aplican sobre la tarifa y se detallan en la factura.Taxes applicable under Venezuelan regulations are charged on top of the rate and itemised on the invoice.
• Los servicios contratados aparte —tiempo adicional, salas fuera de lo incluido, servicios de eventos del complejo— se facturan aparte.Services contracted separately — additional time, rooms beyond what is included, the complex's event services — are invoiced separately.

Si una factura queda sin pagar, te lo decimos y acordamos cómo resolverlo antes de tomar cualquier otra medida. Suspender un servicio es siempre el último paso, no el primero.

If an invoice goes unpaid, we tell you and agree how to resolve it before taking any other step. Suspending a service is always the last step, never the first.

Uso de las instalacionesUse of the facilities

Un coworking funciona porque hay gente distinta trabajando a la vez en el mismo sitio. Lo que pedimos cabe en pocas líneas:

A coworking space works because different people are working at the same time in the same place. What we ask fits in a few lines:

• Usar el espacio para la actividad profesional acordada, y dentro de la ley.Use the space for the agreed professional activity, and within the law.
• Cuidar el mobiliario y los equipos, y avisarnos si algo se daña. Lo que se rompe se arregla; lo que no se avisa se descubre tarde.Look after the furniture and equipment, and tell us if something breaks. What breaks gets fixed; what goes unreported gets discovered late.
• Respetar el trabajo de los demás en las zonas compartidas: las llamadas y las reuniones tienen su sitio, y por eso existen las cabinas y las salas.Respect other people's work in shared areas: calls and meetings have their place, which is why the booths and rooms exist.
• No ceder ni subarrendar tu puesto, tu oficina o tu credencial a terceros sin acordarlo con nosotros.Do not transfer or sublet your desk, your office or your access card to third parties without agreeing it with us.
• Registrar a tus visitas en recepción. El edificio tiene control de acceso y las visitas entran acompañadas.Register your visitors at reception. The building has access control and visitors come in accompanied.

La red wifi es para trabajar. No se puede usar para actividades ilícitas, para vulnerar sistemas ajenos ni para saturar el ancho de banda común. Si tu trabajo necesita condiciones particulares de red, dinos y lo vemos.

The wifi network is for work. It may not be used for unlawful activity, to compromise other people's systems, or to saturate shared bandwidth. If your work needs particular network conditions, tell us and we will look at it.

Tus cosas son tuyas y tu responsabilidad. Hay vigilancia y control de acceso, y aun así lo de valor conviene guardarlo bajo llave: las oficinas privadas y los lockers están para eso.

Your belongings are yours and your responsibility. There is security and access control, and even so, valuables are best kept locked away: private offices and lockers exist for that.

El complejo y sus normasThe complex and its rules

Chimanta Work está dentro de Ciudad Comercial Petroriente. El complejo tiene sus propias normas de acceso, circulación, estacionamiento y seguridad, y sus propios horarios de apertura, que se aplican a todo el que entra. Te las damos al empezar y están disponibles en recepción.

Chimanta Work is located inside Ciudad Comercial Petroriente. The complex has its own access, circulation, parking and security rules, and its own opening hours, which apply to everyone who enters. We give them to you at the start and they are available at reception.

Los espacios de evento, el hotel y los servicios comerciales del complejo los presta el propio complejo y tienen sus condiciones aparte. Cuando te ayudamos a coordinarlos, lo hacemos como puente, no como prestador.

The complex's event spaces, hotel and commercial services are provided by the complex itself and have their own terms. When we help coordinate them, we do so as a bridge, not as the provider.

Cuentas corporativasCorporate accounts

Cuando una empresa contrata para su equipo, la empresa es la titular del acuerdo y responde por el uso que hacen las personas que designa. Eso implica tres cosas prácticas:

When a company contracts for its team, the company holds the agreement and is responsible for the use made by the people it designates. That means three practical things:

• La empresa nos dice quién entra y quién deja de entrar. Las altas y las bajas de credencial las gestionamos con quien nos indique.The company tells us who comes in and who stops coming in. Card activations and deactivations are handled with whoever they nominate.
• La facturación va a nombre de la empresa, con los datos fiscales que nos entregue.Invoicing is issued to the company, with the tax details it provides.
• Estas condiciones se aplican a cada persona del equipo igual que si hubiera contratado ella.These terms apply to each member of the team exactly as if they had contracted themselves.

Uso de este sitioUse of this site

Procuramos que lo que dice el sitio sea exacto y esté al día, y aun así puede haber un dato desactualizado o un error. Las descripciones, las capacidades y los servicios se ofrecen a título informativo; lo que obliga es la propuesta o el acuerdo escrito.

We work to keep the site accurate and up to date, and even so a detail may be out of date or wrong. Descriptions, capacities and services are provided for information; what binds is the written proposal or agreement.

No garantizamos que el sitio esté disponible sin interrupción: depende de servicios de terceros y del mantenimiento. Si necesitas algo y el sitio no responde, escríbenos o llámanos, que ahí sí respondemos.

We do not guarantee uninterrupted availability of the site: it depends on third-party services and on maintenance. If you need something and the site is not responding, write to us or call, because there we do respond.

Al usar el sitio te comprometes a no intentar acceder a partes no públicas, no extraer su contenido de forma masiva para reutilizarlo, y no introducir código que lo dañe o que afecte a quienes lo visitan.

The name Chimanta Work, its logo, the texts, photographs and design of this site belong to PINAPLEX, LLC or are used with permission. They may be quoted and linked to; they may not be copied for commercial use without written permission.

Lo tuyo sigue siendo tuyo. Tu marca, tus documentos y todo lo que produzcas trabajando aquí son tuyos, y no adquirimos ningún derecho sobre ello por el hecho de que trabajes en nuestras instalaciones. Si alguna vez queremos mencionar a tu empresa como cliente o usar tu logotipo, te lo pedimos antes.

Yours remains yours. Your brand, your documents and everything you produce working here are yours, and we acquire no rights over them by virtue of your working in our facilities. If we ever want to mention your company as a client or use your logo, we ask you first.

Límites de responsabilidadLimits of liability

Respondemos por lo que depende de nosotros: prestar el espacio y los servicios contratados en las condiciones acordadas, y responder si incumplimos.

We are responsible for what depends on us: providing the contracted space and services under the agreed conditions, and answering for it if we fail to do so.

No respondemos por los bienes que dejes sin custodia, por el contenido de tu trabajo ni por tu relación con tus clientes o proveedores; tampoco por las interrupciones de suministros públicos, telecomunicaciones o servicios de terceros que estén fuera de nuestro control, más allá de las soluciones descritas en el apartado de cambios y cancelaciones.

We are not responsible for belongings left unattended, for the content of your work, or for your relationship with your clients or suppliers; nor for interruptions in public utilities, telecommunications or third-party services outside our control, beyond the remedies described in the changes and cancellations section.

Salvo en los casos en que la ley no lo permita, nuestra responsabilidad por un servicio determinado no supera el importe que hayas pagado por ese servicio.

Except where the law does not allow it, our liability for a given service does not exceed the amount you have paid for that service.

Nada de lo anterior limita los derechos que la ley te reconozca de forma imperativa.

None of the above limits the rights the law grants you on a mandatory basis.

Ley aplicable y controversiasGoverning law and disputes

Estas condiciones se rigen por las leyes del estado de Delaware, Estados Unidos, sin perjuicio de las normas imperativas del lugar donde se presta el servicio.

These terms are governed by the laws of the State of Delaware, United States, without prejudice to the mandatory rules of the place where the service is provided.

Para las operaciones prestadas en Venezuela, cualquier controversia se somete a los tribunales competentes de la ciudad de Maturín, estado Monagas.

For operations provided in Venezuela, any dispute shall be submitted to the competent courts of the city of Maturín, Monagas State.

Antes de llegar ahí, las partes se comprometen a intentar una solución amistosa: una conversación directa y, si hace falta, una mediación. En la práctica casi todo se resuelve en ese paso.

Before reaching that point, the parties undertake to attempt an amicable solution: a direct conversation and, if needed, mediation. In practice almost everything is resolved at that step.

Podemos actualizar estas condiciones. Cuando lo hagamos cambia la fecha de arriba, que es la forma de saber qué versión estás leyendo. Los cambios se aplican a partir de su publicación y no afectan a lo ya contratado, que se rige por las condiciones vigentes cuando se firmó.

We may update these terms. When we do, the date above changes, which is how you know which version you are reading. Changes apply from their publication and do not affect what has already been contracted, which is governed by the terms in force when it was signed.
